Terms of Service

• "Kolony" means the platform at kolony.lol and its related services, including tracked referral links and the tracking endpoints used by KleePay's own systems.
• "KleePay", "we" means KleePay Limited, the operator of Kolony.
• "Team member" means a KleePay employee or contractor with a Kolony account.
• "Affiliate" means a creator who has accepted an invitation to the KleePay affiliate programme and been issued a referral code.

Access to the Kolony console is limited to team members signing in with an approved Google Workspace account. Accounts are personal and must not be shared. KleePay may suspend or remove access at any time. Affiliates do not receive console access under these terms; they interact with Kolony through the referral links and emails we send.

Team members must use Kolony only for the purpose of building creator partnerships for KleePay and must:

• contact creators only in connection with the affiliate programme, honour every request to stop, and never send messages that are misleading or that misrepresent the programme's terms;
• comply with applicable email and marketing laws, including identifying KleePay as the sender and providing a way to opt out;
• not export creator information for use outside KleePay, and not use it for advertising or resale;
• comply with the terms of the platforms whose data Kolony uses, including the YouTube Terms of Service, the YouTube API Services Terms of Service, and the developer terms of X and Reddit;
• not attempt to circumvent access controls, rate limits or quotas, or to probe or disrupt the service.

Kolony retrieves public information through official platform APIs. That information belongs to the respective platforms and creators and is subject to their terms. Kolony refreshes or deletes stored platform data within 30 days and does not make it available outside the KleePay team. Nothing in these terms grants any right to platform data beyond what the platform's own terms allow.

The commercial terms of the affiliate programme (commission rates, the attribution window, the commission period, the hold period before commissions become payable, minimum payout and payment method) are stated in the invitation an affiliate accepts and shown in Kolony. In summary, at the date above: referrals are attributed to the last referral link a customer clicked within 90 days before signing up; commission accrues on qualifying activity for 12 months after signup; commissions become payable 90 days after the activity they relate to, so that refunds and chargebacks can be reversed; and reversed activity reduces commission accordingly. KleePay may change programme terms for future activity with notice; changes never reduce commission already earned under the terms in force at the time.

Affiliates must not earn commission on their own accounts or on accounts they control, must not use paid search on KleePay's brand terms, must disclose the affiliate relationship where the law or platform rules require it, and must not present themselves as KleePay. Commission arising from fraud, self-referral or misleading promotion may be withheld or reversed.

Referral links and the tracking API exist for KleePay's own systems. Sending fabricated events, replaying events, or generating artificial clicks is prohibited and may result in removal from the programme and forfeiture of unpaid commission.

Kolony, its design and its code are owned by KleePay. Creators retain all rights in their own content and profiles. Affiliates receive a limited, revocable licence to use KleePay's name and approved marketing materials to promote the programme, and nothing more.

How Kolony handles personal information is described in the Privacy Policy, which forms part of these terms.

Kolony is provided as an internal tool without any guarantee of availability. KleePay may modify or discontinue features at any time. We may update these terms; the effective date above shows the current version, and continued use after a change constitutes acceptance.

To the extent permitted by law, Kolony is provided "as is" and KleePay is not liable for indirect or consequential loss arising from its use. Nothing in these terms limits liability that cannot be limited by law, or KleePay's obligation to pay commission properly earned under an affiliate agreement.
